行政裁量权基准制度是十八届四中全会对法治政府建设提出的具体要求之一。针对目前我国行政裁量权基准制度存在的位阶低、科学性差、制定程序简单等问题,应通过科学立法、民主参与提高行政裁量权基准制度的立法位阶,科学合理确定行政裁量权基准制度的基本框架等对策予以完善。
