外交保护是国际法上一项传统的法律制度,它涉及一系列复杂的理论与实践问题。目前,联合国国际法委员会正在制定外交保护方面的条款草案。随着经济全球化的发展,中国也正实践着“走出去”的战略,研究外交保护法律制度对中国国际法学界的理论与实践有着重大意义。同时,外交保护法律制度与当代国际法领域的其他理论问题也相互促进,交互影响。
Diplomatic protection is a traditional legal system in international law that involves a series of complex theoretical and practical issues. Currently, the United Nations International Law Commission is developing draft articles on diplomatic protection. With the development of economic globalization, China is also practicing the strategy of “going out” and studying the legal system of diplomatic protection is of great significance to the theory and practice of China’s international jurisprudence. At the same time, the legal system of diplomatic protection and other theoretical issues in contemporary international law also promote and interact with each other.
