随着移动互联网经济的发展,移动应用APP对人们的生活提供了更加方便和优质的服务。由于移动互联网发展迅猛,相关的法律法规不够完善,行业规制缺失,在利益的诱导下移动应用商标侵权现象频发。应当完善对APP恶意侵权的规制:完善惩罚性赔偿制度,细化对“恶意”和“情节严重”的认定,重视权利人的过错程度;细化法定赔偿的参考要素,特别是完善对“恶意”程度的认定,以及对商标“显著性”和“知名度”的认定;惩罚性赔偿和法定赔偿不应并用。还应加强对“恶意抢注”的预防和惩治,特别是细化《商标法》对“恶意抢注”行为的认定,并扩大对驰名商标的保护。
With the development of mobile Internet economy, mobile application APP provides more convenient and quality service to people’s life. We should also strengthen the prevention and punishment of “malicious squatting”, in particular, refine the “Trademark Law” on the “malicious squatting” act of recognition, and expand the protection of well-known trademarks.
