附赠式有奖销售作为一种促销手段在经济生活中被广泛采用,但现有制度对其规定甚少。本文主要从附赠式有奖销售的性质入手,认为其属于单一的买卖合同,以此为基础确定其中的赠品责任问题,并进一步提出完善附赠式有奖销售法律规制的一些建议。
Bonus prize-winning sales as a marketing tool in economic life has been widely used, but the existing system of its provisions little. This article mainly starts with the nature of the bonus-covered sales, considers it to be a single sale and purchase contract, and determines the responsibility of the gifts as the basis for the sale. Some suggestions are put forward to perfect the legal regulation of the bonus-covered sales.
