城市房屋拆迁纠纷频繁,关键问题在于其程序设计不合理。在分析我国城市房屋拆迁补偿安置程序存在的问题、正当程序之构建要素及借鉴美国行政征收程序的基础上,构建以行政主体为主导的拆迁补偿安置正当程序,并提出构建城市房屋拆迁补偿安置正当程序的具体建议。
