随着大规模的基础设施建设,城市拆迁房屋数量急剧增加,房屋拆迁所引起的争议层出不穷,例如强拆或钉子户现象。因此,本文就房屋拆迁的法律制度进行讨论。近几年来,大量的基础设施建设一方面丰富了和方便了人们的生活,但另一方面,强拆和钉子户现象也是一个令人头疼的问题,这是因为房屋拆迁赔偿制度不完善所引发的一系列社会问题。有些钉子户是因为故土难离或者是赔偿过低,无法令人满意,也有一些人是希望能从中谋取暴利,相对的因而产生了强拆问题。因此,房屋拆迁如果没有合理详细的法律规范,势必会给国家和人民带来难以估量的损失。同样的,房屋拆迁如是没有合理的补偿制度,则会造成社会矛盾的激化。
With the large-scale infrastructure construction, the number of houses demolished in urban areas has risen sharply. Some nail households because of the difficulty of homeland or compensation is too low, unsatisfactory, there are some people who hope to make huge profits, the relative has led to demobilization. Therefore, if there is no reasonable and detailed legal regulation on house demolition, it is bound to bring immeasurable losses to the country and the people. Similarly, if housing demolition does not have a reasonable compensation system, it will result in the intensification of social conflicts.
