认罪认罚从宽制度是刑事诉讼改革之重要议题,量刑协商程序则是认罪认罚从宽制度创新之实质表现,主体诉讼权利的实现更是量刑协商程序之价值追求。然而,在对司法实践中其主体角色的演绎进行动态化与现实化考量后,暴露出的却是控辩双方量刑协商权益失衡与当事人诉讼权利不对等的冲突实质。因此,在协商理念与主体理论的基础上,从量刑协商主体冲突之调试与衡平出发,规范检察机关从宽适用,发挥值班律师辩护职能,保障被追诉人合法权利,考察被害人建议意见,重塑协商式刑事诉讼模式,保障认罪认罚从宽制度之平稳运行与健康发展。
