跨国公司作为法人,存在复杂的国籍认定问题。其复杂性体现在:首先,互联网环境中,跨国公司本身定义的变化,加上“屏对屏”的经营方式和虚拟化的形态,淡化了国家边界,不确定因素的干扰较多。其次,跨国公司国籍问题可从法学、经济学、管理学或国内法、国际法等不同视角分析观察,可能出现概念的混乱。再者,法人国籍确定标准尚未统一,各国不同规定产生法律冲突。为解决国籍难题,国际社会有必要通过条约等手段加以协调统一。
Multinational corporations, as legal persons, have complicated nationality issues. The complexity is reflected in the following: Firstly, in the Internet environment, the changes defined by multinational corporations themselves and the mode of operation of “screen-to-screen” and the form of virtualization have played down the interference of national borders and uncertainties. Second, the question of the nationality of transnational corporations can be observed and analyzed from different perspectives, such as law, economics, management or national law, international law, and confusion in concepts. Furthermore, the standard for determining the nationality of legal persons has not been uniformed and conflicts of laws exist in different countries. In order to solve the nationality problem, it is necessary for the international community to harmonize through treaties and other means.
