本文简单介绍了张先著一案,并结合我国宪法救济制度的特点提出在现有法律框架内几种可行的解决方案。探讨了法律救济和宪法救济的关系,宪法救济的适用条件以及公民启动违宪审查程序应遵循的几项原则,以求为完善我国宪法救济制度尽绵薄之力。 This article briefly introduces the case of Zhang Xianzhao and puts forward several feasible solutions within the existing legal framework according to the characteristics of China’s constitutional relief system. Discusses the relationship between legal remedies and constitutional remedies, the conditions for the application of constitutional remedies and the principles that citizens should follow in order to start the review of unconstitutional acts so as to make every effort to improve the constitutional remedy system in our country.
