沉默权是现代刑事诉讼中犯罪嫌疑人、被告人的一项基本权利,是无罪推定原则的核心内容。确立沉默权有利于加强对犯罪嫌疑人、被告人的基本人权的保障;有利于遏制刑讯逼供行为,客观上促进我国法证工作的进步,符合中国现实国情。同时就我国现阶段确立沉默权制度提出相应建议。 The right to silence is a basic right of criminal suspects and defendants in modern criminal proceedings and is the core of the principle of presumption of innocence. The establishment of the right to silence is conducive to strengthening the guarantee of the basic human rights of the suspects and the accused. It is conducive to curbing the act of extorting a confession by torture and objectively promoting the progress of the forensic work in China, which is in keeping with China’s actual conditions. At the same time, we put forward corresponding suggestions on the establishment of the right to silence system in our country.
