跨越3个年头,审议4次之多,《中华人民共和中道路交通安全法》(以下简称《道交法》)终于尘埃落定,并于2004年5月1日起正式出台实施。从法律条款上看,《道交法》确立了农业(农业机械)主管部门对上道路行驶的拖拉机行使登记、考核、发证、定期检验等管理职权。而这一职权已由过去公安部门委托行使演变为国家法律直接授权行使。应该说,这是中国农机发展史上的一大进步,是建国以来所没有的,是对农机安全管理部门法律地位的首次认定,也是人大代表代表人民,行使民主权力管理国家的充分体现。
It took more than three years to consider as many as four times. The Law of the People’s Republic of China on Road Traffic Safety (hereinafter referred to as “Road Traffic Law”) finally came to an end and was formally promulgated on May 1, 2004. Judging from the legal provisions, the “Road Traffic Law” established the management authority of the agricultural (agricultural machinery) authorities on the registration, examination, certification and periodic inspection of the tractors driving on roads. And this power has been entrusted by the public security department in the past evolved into national law directly authorized to exercise. It should be said that this is a great progress in the history of the development of China’s agricultural machinery. It was not established since the founding of the People’s Republic of China. It is the first recognition of the legal status of the farm machinery safety management department. It is also a manifestation of the deputies represented by the National People’s Congress on behalf of the people and the exercise of democratic power in administering the country.
