在党的十八届三中全会《决定》的背景下,为步入后农业税时代的我国从法律方面推进新农村建设,加快农村集体经济发展提供第一手资料和现实依据,课题组采取社会实证调研分析方法对农地调整和农地流转法律制度的运行情况进行考察,特对广东省三县六镇十二村开展调研。调查表明,我国在实行“大稳定、小调整”的策略下,应逐步推行地租制以弥补“增人不增地,减人不减地”政策的缺陷,同时丰富农地流转方式,并适当简化其流转程序,尊重村民的行为自治,充分发挥村集体的统一领导作用,建立抛荒地预警和微调机制,实现土地承包经营权长期稳定的现实与法律目标。
