本文对20世纪的有代表性的民法诸学说,分别予以扼要的评说,指出其同异之处,并与19世纪民法学说进行了比较辨析,还探讨了民法学思潮嬗变演进的若干因素。作者认为,本世纪民法诸学说均从不同角度并在不同程度上丰富和发展了民法解释学的理论和方法,最终克服了概念法学,将民法解释学推向了一个全新的境界。
This article gives a concise commentary on the representative civil law theories of the 20th century, points out the similarities and differences, and makes a comparative analysis with the nineteenth century civil law theories. It also discusses several factors that have led to the evolution of the civil law trend of thought. The author believes that all the theories of civil law in this century have enriched and developed the theories and methods of civil law hermeneutics from different perspectives and to varying degrees, eventually overcoming the concept of jurisprudence and pushing civil law hermeneutics to a whole new level.
