本文旨在对康德法权学说中的自由概念进行探讨。通过对任意自由的一般定义、自由的实在性、自由的人格性定义、自由和强制、作为法权的自由的概念及其关系的探讨,剖析了自由概念变化的过程,并尝试以知性的三个范畴来理解这些变化之间的逻辑关系,指出作为法权的自由以任意的一般定义和人格性定义作为基础,并在更高层次上包含了后两者。文章最后对作为法权的自由如何实现进行了探讨。
This article aims to explore the concept of freedom in Kant’s legal doctrine. Through the discussion of the definition of free freedom, the definition of freedom, the definition of free personality, freedom and compulsion, the concept of freedom as a legal right and its relationship, this paper analyzes the process of the change of concept of freedom, To understand the logical relationship between these changes and to point out that freedom as a legal power is based on an arbitrary general definition and personality definition and includes the latter two at a higher level. Finally, the article explores how to realize the freedom as a legal right.
