承租人根本违约,出租人可行使解除权作为一种重要的救济途径。但何时可以直接解除合同或应先催告再行使解除权,对出租人有不同的意义。本文通过比较分析认为:动产和不动产租赁对出租人解除合同的要求应是有区别的;承租人无正当理由未支付或延迟支付租金时,对出租人行使解除权的方式应作不同的要求;基于此,应对我国《合同法》第227条进行修改。
The lessee is in default and the lessor can exercise the right of termination as an important remedy. However, when the contract can be rescinded or should be resumed first, the lessor has different meanings to the lessor. This article through the comparative analysis thinks: The movable property and the real estate lease should have the different request to the lessor to cancel the contract; the lessee should make the different request to the lessor in exercising the right of cancellation when the lessee has not paid or delayed the payment of the rent without proper reason; Based on this, Article 227 of China’s Contract Law should be amended.
