伴随着中国城市化步伐的加快、污染问题的升级,城市绿色保护理念逐渐深入人心,得到政府与市民的广泛关注,然而其中的问题也随之凸现了出来。本文从执法现状中的问题入手,逐步引出导致这些问题的根源——立法缺陷。并具体从环境权、上下位法之间的矛盾解析、后期监督责任归属三个方面提出针对以上漏洞的治理意见。 With the accelerating pace of urbanization in China, the upgrading of pollution and the concept of urban green protection gradually gaining popularity among the people and the government and citizens, however, problems have also emerged. This article starts with the problems in the current situation of law enforcement, and gradually leads to the root causes of these problems - the legislative defects. And specifically from the environmental rights, the contradiction between the upper and lower methods of analysis, the responsibility of the latter part of the supervision oversight put forward the governance views for the above loopholes.
