对于无形财产权而言,登记对于权利的界定、权利状态的公示以及交易的便利均具有重要价值。然而,在《伯尔尼公约》的协调之下,版权的强制登记制度已不复存在。重建基于确权目的之版权强制登记制度将会面临极大障碍,基于侵权救济目的之登记制度也难以取得理想效果。互联网技术的发展和在线版权交易平台的兴起为版权登记制度的革新提供了第三条道路。基于交易的版权登记契合知识产权法原理,具有正当性。在线版权交易平台进行登记和审查的必要性源于其合理注意义务。该方案可在现行法律框架之下展开。为取得理想效果,有必要为版权登记提供激励,并实施区别化的审查机制。这种登记方案不失为破解版权登记制度之两难命题的一种优选方案。
For intangible property rights, registration is of great value to the definition of rights, the publicity of rights status and the facilitation of transactions. However, under the “Berne Convention,” the compulsory registration of copyright no longer exists. The reconstruction of copyright compulsory registration system based on the purpose of confirming the right will face great obstacles, and the registration system based on the purpose of infringement relief will be hard to achieve the desired results. The development of Internet technology and the rise of online copyright trading platform provide a third way for the reform of copyright registration system. Transaction-based copyright registration meets the principles of intellectual property law, with legitimacy. The need for online copyright trading platforms to register and review stems from their reasonable care obligations. The program can be carried out under the current legal framework. In order to achieve the desired result, it is necessary to provide incentives for the registration of copyright and to implement a differentiated censorship mechanism. This registration scheme is a preferable solution to the dilemma of the copyright registration system.
