由于我国刑事立案管辖制度对立案管辖权的划分不够清晰、合理,导致司法实践中立案管辖制度规定的粗疏,且法律、司法解释、各部门规定的内容不统一,缺乏协调性;公、检、法三机关的刑事立案管辖权划分不科学、交叉管辖、互相扯皮的现象时有发生;立法上未明确规定国家安全机关、军队保卫部门的刑事立案管辖权限,理论界对于监狱是否应该享有立案管辖权也存在争议。文章从立案管辖的划分标准等三个角度对我国现行刑事立案管辖制度提出质疑,为现行制度的合理运行提出一些完善相关立法的补救措施。
Due to the fact that the jurisdiction of our country’s criminal record-filing system is not clear and reasonable to the jurisdiction of filing cases, the provisions of jurisdiction system in judicial practice are lax, and the legal and judicial interpretations are inconsistent. The jurisdiction of criminal and judicial authorities of the three branches of law has not been scientifically defined, and the phenomena of cross jurisdiction and reciprocal wrangling have taken place from time to time. The legislation does not clearly stipulate the jurisdiction over criminal cases of state security organs and military security departments. Whether or not jurisdictions should have jurisdiction over criminal cases Rights are also controversial. The article questions the current system of criminal case jurisdiction from three angles of division of jurisprudence and puts forward some remedies to improve the reasonable operation of the current system.
