微博,即微博客(Micro Blog)的简称,是一个新兴的网络信息传播平台。从2009年8月中国门户网站新浪推出“新浪微博”内测版,成为门户网站中第一家提供微博服务的网站之后,微博用户如雨后春笋般涌现。直至2013年上半年,新浪微博注册用户达到5.36亿。微博凭借其强大的媒体融合功能和前卫的碎片化表达特性,在为信息传播带来便利的同时,也为侵权行为大开“方便之门”。鉴于此,本文将从个体和微博平台两个主体的角度针对不同微博侵权行为进行归责,并提出笔者的建议。
Weibo, the abbreviation of Micro Blog, is a new network information dissemination platform. From August 2009, Sina launched the “Sina Weibo” beta version of the Chinese portal Sina, and became the first portal in the portal to provide Weibo service after the microblogging users sprung up. Until the first half of 2013, Sina Weibo reached 536 million registered users. With its strong media convergence capabilities and avant-garde fragmented expression characteristics, Weibo opened the door to convenience while spreading the convenience of information dissemination. In view of this, this article will be responsible for the different Weibo infringement from the perspective of individuals and Weibo platform, and put forward the author’s suggestions.
