我国民事诉讼审前程序的功能在传统上主要被定位于审前准备,使案件达到适合于审理的程度,从而使审前程序沦为庭审程序的附庸.但于现代民事诉讼理念,审前程序还应具有一项重要的独立性功能——促进纠纷早日解决.本文拟从澄清相关概念着手,对我国审前程序现状进行梳理分析,以期探讨出一条适用于我国的审前程序构建之路. The function of pre-trial procedure of civil procedure in our country is traditionally mainly located in pre-trial preparation, so that the case reaches the appropriate level for trial, so that the pretrial procedure is reduced to the appendage of trial procedure.But in the concept of modern civil procedure, pre-trial procedure But also has an important function of independence - to promote the early settlement of disputes.This paper intends to clarify the relevant concepts from the review of the status quo of China’s pre-trial analysis, with a view to explore a suitable pre-trial procedures for building our country.
