(一) 在犯罪学演变的整个过程中,犯罪学研究者们集中力量研究的是被称为“传统的犯罪”这一领域。这些传统的犯罪通常与更为严重的普通法罪行,诸如强奸、入屋犯罪、偷盗和谋杀相联系。因此,法律结构的发展基本上只限于对付这样一些犯罪类型。但是,随着现代技术的兴起,非传统的犯罪日益盛行和引起人们的关注。电子革命给了罪犯以一种新的工具。借助于现代技术,他可盗窃数以百万计的美元。利用计算机犯罪是这一新时代的产物,它不仅值得我们研究,而且考验我们的社会是否有能力使其基础的法哲学适应变化中的技术挑战。
(A) Throughout the evolution of criminology, criminology researchers have focused their efforts on the area known as the “traditional crime.” These traditional crimes are often linked to more serious common law crimes such as rape, crime in homes, theft and murder. Therefore, the development of the legal structure is basically confined to dealing with such types of crimes. However, with the rise of modern technology, non-traditional crimes are increasingly prevalent and attract the attention of people. The electronic revolution gave criminals a new tool. With modern technology, he can steal millions of dollars. The use of computer crime as a product of this new era is not only worth our research, but also tests whether our society is capable of adapting its fundamental jurisprudence to changing technological challenges.
