本文根据法国外交部档案馆所藏的土地申请和土地契约档案,对学界关于法国领事馆契的问题进行了探讨。本文初步得出以下结论:法国领事馆契是由法国领事和上海道台签发给在法租界区租地外国人的土地凭证。从第1号法国领事馆契,一直到1875年,其制式并未发生改变。这种制式与1847年颁发的最早英国道契并不相同,相反,却与1854年土地章程规定道契制式基本相同。法领事馆契与他国领事馆颁发道契的唯一区别在于,前者仅颁发给所有在法租界租地的外国人,无论国籍,而后者仅为其本国人颁发。
This article based on the French Ministry of Foreign Affairs archives of land applications and land contract files, the academic circles on the French consulate deed problems were discussed. This article concludes with the following preliminary findings: The French consular deed is a certificate of land issued by French consuls and Shanghai Taotai to foreigners who rent in the French Concession area. From the French Consulate contract No. 1, until 1875, its standard has not changed. This system is not the same as the earliest British deed issued in 1847, on the contrary, it is basically the same as that stipulated in the 1854 land charter. The only difference between a French consular deed and a foreign consular post is that the former is only issued to all foreigners rented on the French Concession, irrespective of nationality, and the latter is issued only to their own nationals.
