劳动争议调解制度作为当前非诉讼纠纷解决机制的代表制度之一,应该成为劳动争议“私”处理的主渠道。通过对劳动争议调解制度的现状分析,只有采取区分利益争议,建立区域性劳动争议调解组织,落实工会职责,明确调解协议效力,并在制度外培育用工的良好环境,才能形成立体全方位的和谐劳动争议调解制度。
As one of the representative systems of non-litigation dispute resolution system, labor dispute mediation system should become the main channel of labor dispute “private ” treatment.
