2005年2月28日,全国人民代表大会常务委员会审议通过的《关于司法鉴定管理问题的决定》确立了建立统一司法鉴定管理体制的基本框架,为健全统一司法鉴定管理体制打下了基础。2015年10月22日通过的《黑龙江省司法鉴定条例》赋予省、市(地)司法行政部门对本行政区域内司法鉴定的统一管理权。但在实际工作中,对侦查机关设立的鉴定机构和鉴定人如何进行管理以及怎么规范是目前急需解决的问题。为此,经过对侦查机关司法鉴定机构的梳理,从侦查机关内部和外部强化机制建设,整合侦查机关鉴定机构和人员;剥离其职能;完善行业协会的行业管理;加强对侦查机关司法机关机构的监督管理等方面,提出可行性建议和采取的措施,最终建立社会鉴定机构和侦查机关鉴定机构并存的体制。
On February 28, 2005, the Decision on the Administration of Judicial Expertise examined and approved by the Standing Committee of the National People’s Congress established the basic framework for establishing a unified judicial appraisal management system, laying the foundation for the establishment of a unified administration system for judicial appraisals. The Heilongjiang Provincial Forensic Examination and Accreditation Regulations passed on October 22, 2015 give the judicial administrative departments of the province (city) (or prefectural) jurisdiction over the unified management of judicial appraisals within their respective administrative regions. However, in practical work, it is an urgent issue to be solved how to regulate the appraisal agencies and appraisers established by the investigation authorities and how to regulate them. To this end, after the investigation of the judicial identification of institutions to sort out, from inside and outside the investigation agency to strengthen the mechanism of construction, integration agencies and personnel of detection agencies; peel off their functions; improve the industry associations trade associations; strengthen the judicial organs of the investigating authorities Supervision and management and other aspects, put forward feasible suggestions and measures to be taken, and finally establish a system in which the social appraisal agency and the appraisal agency of the investigating authorities coexist.
