2007年初以来,美国出现了一场次级抵押贷款危机,这场危机后来演化成为全球金融风暴,并以惊人的速度蔓延,对西方金融机构和全球金融市场的冲击不亚于10年前的亚洲金融危机。它与美国房地产的衰退结合发酵,使美国经济的发展进一步放缓,并对世界经济产生一定的负面影响。造成这场次贷危机原因很多,本文试图从法律角度分析促使危机发生的原因,并从中得出其对我国公法和私法的法制建设的重要启示。
Since the beginning of 2007, the United States has witnessed a subprime mortgage crisis that later evolved into a global financial crisis that spread at an alarming rate and hit Western financial institutions and global financial markets as badly as Asia’s financial system 10 years ago crisis. Its combination with the decline of the U.S. real estate industry has further slowed the development of the U.S. economy and has had some negative impact on the world economy. There are many reasons for this subprime mortgage crisis. This article attempts to analyze the causes of the crisis from a legal point of view, and draws the important enlightenment to the legal system construction of public and private law in our country.
