近年来,我国价格改革迈出了较大的步伐,这对促进经济发展起到了积极作用.同时,由于价格形成和约束机制尚不完善,市场行为不规范,商品流通渠道混乱,扰乱了价格秩序,特别是价格欺诈和牟取暴利问题时有发生,在社会上引起较大反响.针对市场上出现的这些情况,国家、省上相继出台的一系列政策、法规,将制止价格欺诈和牟取暴利作为市场检查的重点,常抓不懈.为了更好地贯彻执行国家的有关政策法规,西安市政府根据本市实际,于1994年11月出台了《西安市反价格欺诈和牟取暴利暂行规定》.通过几年的实践,经反复修改,于1996年12月经陕西省人大常委会批准正式颁布了《西安市制止价格欺诈和牟取暴利条例》.这为规范市场价格行为提供了保障,也为价格监督检查部门查处价格欺诈和牟取暴利行为提供了更为有力的法律武器.
In recent years, China’s price reform has taken a big step, which has played a positive role in promoting economic development. At the same time, due to the imperfect price formation and restraint mechanisms, unregulated market behavior, confusion of commodity distribution channels, and disruption of price order. In particular, price fraud and profiteering problems have occurred from time to time and have caused great repercussions in the society. In response to these situations in the market, a series of policies and regulations that have been introduced by the state and the province will prevent price fraud and profiteering. In order to better implement the relevant policies and regulations of the country, Xi’an Municipal Government issued the “Provisional Regulations on Anti-price Fraud and Exorbitant Profits in Xi’an City” in November 1994 in accordance with the actual conditions of this Municipality. The practice of several years, after repeated revisions, was formally promulgated by the standing committee of the Shaanxi Provincial People’s Congress in December 1996 and promulgated the “Regulations on Price Suppression and Extortion of Profits in Xi’an City.” This provided guarantee for the regulation of market price behavior, and also for price supervision and inspection. The department has investigated and dealt with price fraud and profit-taking behavior to provide more powerful legal weapons.
