各省、自治区、直辖市人民检察院,军事检察院:现将国务院发布的《国家赔偿费用管理办法》转发给你们,请认真执行。各级检察机关要按照《中华人民共和国国家赔偿法》和《国家赔偿费用管理办法》的规定,及时商同级财政部门,做好年度预算,落实赔偿经费。对已决定以支付赔偿金的方式给予赔偿的,要在法律规定的期限内,及时从预算经费中先行支付。如经费不足,应及时向同级财政部门申请核拨。各地在执行《国家赔偿费用管理办法》中遇到的问题,应与同级财政部门协商解决,并层报最高人民检察院。1995年3月17日
People’s Procuratorates and Military Procuratorates of all provinces, autonomous regions and municipalities directly under the Central Government: We hereby forward to you all the Measures for the Administration of State Compensation Expenses promulgated by the State Council. Please implement this conscientiously. Procuratorial organs at all levels should make timely efforts to make annual budgets and implement compensation funds according to the provisions of the “Law of the People’s Republic of China on State Compensation” and the “Measures for the Administration of State Compensation Costs”. Those who have already decided to pay compensation in the form of compensation should be paid within the time limit prescribed by law in a timely manner from the budgetary funds. If the funds are insufficient, they should promptly apply to the financial departments at the same level for appropriation. Issues encountered in the implementation of the Measures for the Management of State Compensation Costs should be resolved through consultation with the financial departments at the same level and reported to the Supreme People’s Procuratorate.
