以司法鉴定为切入点,通过案例分析,阐述了特种养殖动物和珍禽在繁育期间特别容易受到噪声污染的伤害;告诫侵权方在从事生产经营活动中要严格遵守《中华人民共和国环境噪声污染防治法》及《中华人民共和国环境影响评价法》;提醒受害方要树立维权意识并做好证据保全。
Taking the forensic appraisal as the starting point, the case analysis shows that the special breeding animals and rare birds are particularly vulnerable to the noise pollution during the breeding period. The court warned the infringer to strictly abide by the Law of the People’s Republic of China on the Prevention and Control of Environmental Noise Pollution “And” Law of the People’s Republic of China on Environmental Impact Assessment "; remind the victim to establish a sense of rights protection and good evidence preservation.
