检法联合解释在解决法律解释冲突、完善司法解释体制、提高司法解释效率上具有重要价值,实践中存在多种形式。这种做法存在法律依据不明确、制定程序、创制方式有待规范统一、形式规范性略显不足等缺陷,应通过立法明确联合解释在司法解释体制中的法律地位,规范其制定程序、统一创制形式、加强司法审查和法规清理。
The joint interpretation by the method of inspection has important value in resolving the conflict of legal interpretation, perfecting the judicial interpretation system and improving the efficiency of judicial interpretation. There are many forms in practice. This practice has some defects such as unclear legal basis, procedural development, mode of unification to be standardized and slight lack of formal normativity. It should clarify the legal status of judicial interpretation system through legislation, standardize the procedures for its formulation and unify the system of creation , Strengthen judicial review and legal clearance.
