举证责任的分配在医疗侵权诉讼中具有重要意义 ,它直接决定着诉讼的进程 ,同时影响诉讼的结果。本文以举证责任的一般理论为指导、以我国相关立法和实践为立足点 ,对医疗侵权诉讼举证责任的含义、举证责任的分配及其根据等问题进行了论述并提出了作者的观点。
The distribution of the burden of proof is of great significance in medical tort litigation, which directly determines the progress of the litigation and affects the outcome of the litigation at the same time. Based on the general theory of burden of proof and the relevant legislation and practice in our country, this article discusses the implications of the burden of proof on medical tort litigation, the distribution of burden of proof and its basis and puts forward the author’s point of view.
