公安搜查行为对公民宪法权利的强制处分性,决定了其对公民宪法权利侵犯的严重性。“中国式”的非法证据排除规则,在强制排除严重的非法证据的同时,赋予了瑕疵证据可补正的机会。公安侦查程序的瑕疵搜查笔录提升到公民宪法权利保护的高度,从搜查笔录内容结构剖析瑕疵搜查笔录的表现形式,探究其产生原因,进而提出完善瑕疵搜查笔录的设想。
The compulsory punishment of citizens’ constitutional rights by the search of public security acts determines the seriousness of their violation of the constitutional rights of citizens. “Chinese-style ” rule of illegal evidence exclusion, in the mandatory exclusion of serious illegal evidence at the same time, given the flaw evidence can be corrected opportunity.
