据有关数据统计,2013年中国废水中主要污染物排放总量为2 352.7万吨。其中有工业源、生活源、农业源等,当前中国的环境污染是立体化、全方位的。在我国环境受到破坏和污染严峻的形势下,存在数量较多的环境诉讼案件,可现实数据却并非如此。截至到2012年底,全国环保法庭已达95个,受理案件却非常少,可起诉至法院的不足1%,由此可见,环境污染与环境诉讼的不相对应。形成如此大的反差,究其原因与中国现存的环境诉讼体系有关,就中国环境诉讼制度存在问题进行分析,提出制定专门的环境诉讼法;鼓励公民积极参与环境诉讼等完善该制度的措施。
According to the statistics, the total discharge of major pollutants in wastewater in China in 2013 was 23.527 million tons. Among them are industrial sources, living sources and agricultural sources. At present, the environmental pollution in China is three-dimensional and comprehensive. In our country’s environment is damaged and polluting situation, there are a large number of environmental litigation cases, but the actual data is not the case. As of the end of 2012, the number of environmental courts in the country has reached 95, and the number of cases accepted is very small. Less than 1% of the cases can be prosecuted to the courts. From this, we can see that there is no corresponding relationship between environmental pollution and environmental litigation. The reason for such a large contrast is that it is related to China’s existing system of environmental litigation. It analyzes the existing problems in China’s environmental litigation system, proposes the formulation of a special environmental procedure law, and encourages citizens to actively participate in environmental litigation and other measures to improve the system.
