通过分析法官自由裁量权存在的原因,提出了防范法官滥用自由裁量权的建议,即提高法官自身素质,加强对法官的管理,改善法院外部条件,建立健全责任追究制度,一方面赋予和保障法官的自由裁量权,另一方面对其加以适当的规制,以充分发挥其正面价值。
