立体商标,对于大多数人来说还是一个陌生的名词,因为我们印象中的商标一般都是以平面形式出现的。由于与平面商标相比,立体商标具有更直观、鲜活,更能够吸引消费者的注意,它的注册和保护问题近年来受到了越来越多的关注。本案所涉及的商标,是我国通过司法程序赋予权利的第一个立体商标。本案比较全面地反映了立体商标从行政到司法程序的全过程,探讨了立体商标在我国可被核准注册的基本条件,系近年涉及立体商标的典型案例之一。
Three-dimensional mark, for most people is still a strange term, because our impression of the trademark generally appear in a planar form. Due to its more intuitive, vivid and more appealing to consumers than flat printing, its registration and protection issues have received more and more attention in recent years. The trademark involved in this case is the first three-dimensional trademark that China has given its rights through judicial procedures. This case reflects the whole process of the three-dimensional trademark from administrative to judicial procedure more completely, and explores the basic condition that the three-dimensional trademark can be approved for registration in our country. It is one of the typical cases concerning the three-dimensional trademark in recent years.
