设定刑事责任是对非法垄断行为进行打击和惩罚的最有效的保障。我国反垄断法律法规对非法垄断行为的刑事责任设定的缺失,是不利于保障市场经济健康发展的。文章肯定设定垄断犯罪的观点,并通过对垄断犯罪的构成要件及其刑罚类型对垄断犯罪予以确立。 Setting criminal responsibility is the most effective guarantee for cracking down and punishing illegal monopoly. The lack of criminal responsibility of China’s antitrust laws and regulations on illegal monopolistic behavior is not conducive to the healthy development of the market economy. The article affirmed the viewpoint of monopoly crime, and established the monopoly crime through the constitutional elements of monopoly crime and the types of punishment.
