2006年中央十六届六中全会通过的《中共中央关于构建社会主义和谐社会若干重大问题的决定》将宽严相济确认为我国新时期的刑事司法政策,它表明了我国新时期刑事司法政策的新发展,必将推动我国司法理念、司法机制乃至司法体制的革故鼎新,促使全社会认识犯罪更加深刻,对待犯罪更加理性,预防犯罪更加合理,惩治犯罪更加有效。其理论支撑与实践依据如下:
