触电案件是否可不区分电压等级而统一适用侵权责任法,这些法律适用问题随之出现,直接给审理触电人身损害赔偿案件带来了严重困扰。如果不区分高低电压,那么触电损害案件究竟该适用侵权责任法第六条还是第七十三条,作为一般侵权案件和作为特殊侵权案件审理所适用的归责原则、责任主体、免责事由、举证责任等都不相同,审理的结果也会天差地别。如果区分高低电压,那么又应依据何种标准加以确定。这些问题使得重新明确对高压电的划分,明确触电损害赔偿案件的法律适用,避免同案不同判现象的发生,维护电力企业合法权益而言具有重要意义。
