拟制定《能源法》的立法工作启动10年却未能走进全国人大立法议程的原因之一,是对它的定性定位缺乏理性认识。对于这一问题主要存在三种观点:综合性、基础性法律;由全国人大制定的作为能源基本法的法律;并非一定要由全国人大制定的作为能源基本法的法律。借鉴间接经验教训是唯物主义方法论下的不可或缺路径。我国现有法律体系及能源法律群状况是理性认识这一问题的客观基础。我国的拟制定《能源法》内容上宜以政策性、原则性和框架性为主,名称上冠以《能源政策基本法》较妥,定性定位应该是能源法律体系中的基本法。
One of the reasons why the proposed enactment of the “Energy Law” started 10 years ago but failed to walk into the legislative agenda of the NPC is that it lacks a rational understanding of its qualitative positioning. There are mainly three kinds of views on this issue: comprehensive and basic laws; the law enacted by the NPC as the basic law of energy; the law that is not necessarily formulated by the NPC as the basic law of energy. Learning from indirect lessons is an indispensable path under materialist methodology. The status quo of the existing legal system and the law of energy in our country is an objective basis for the issue of rational understanding. China’s proposed “Energy Law” content should be based on the policy, principle and framework of the main title of the “Energy Policy Basic Law” better, qualitative positioning should be the basic law of the energy legal system.
