随着城市化进程的步伐逐渐加快,对建设用地的需求也逐步增加,而目前我国原有的建设用地供给量已无法满足城市扩建的需求,必须通过征收农村土地来增加建设用地的供给,大规模的农村土地征收是各方主体利益博弈的过程,纠纷的产生无法避免。从农村土地征收过程中重要的三方主体的特点入手,分析纠纷产生的必然性。应从土地征收立法的完善、执法监督体制的健全以及行政裁决及司法救济程序的完善三个方面,解决征地纠纷。
With the gradual acceleration of the pace of urbanization, the demand for construction land has also gradually increased. At present, the supply of construction land in our country can no longer meet the demand for urban expansion. Therefore, the supply of construction land must be increased through the acquisition of rural land. The scale of rural land expropriation is the process of the game of interests of all parties, and disputes can not be avoided. Starting from the characteristics of the important tripartite subjects in the process of rural land acquisition, the inevitability of disputes arises. We should solve the problem of land acquisition from the following three aspects: perfecting the legislation of land acquisition, improving the law enforcement supervision system and perfecting the administrative adjudication and judicial remedy procedure.
