奥吉娜案件的争议焦点是政府财政部门对于基本药物招标领域是否具有监管职责,其背后的根本问题即是基本药物招标是否适用政府采购法。本文分析了基本药物招标领域中存在的法律关系,并从正反两个角度分析了基本药物招标是否属于政府采购。通过从医改、负责任政府、政府采购法的完善以及行政法的基本原则、抑制行政垄断等方面分析,得出明晰基本药物招标领域财政部门监管责任具有必要性。该案件对于完善我国现有基本药物招标法律体系的启示有二:一是出台配套的法律解释;二是各级政府财政部门制定监管方面的指南性文件。
The focus of the dispute in the Ojina case is whether the government finance department has the regulatory responsibility for the bidding of essential drugs. The fundamental issue behind this is whether the government procurement law is applicable to bidding for essential drugs. This article analyzes the legal relationship existing in the field of essential drug bidding and analyzes whether the bidding of essential drugs belongs to government procurement from both positive and negative perspectives. Through the analysis of health reform, responsible government, the improvement of government procurement law and the basic principles of administrative law and the suppression of administrative monopoly, it is necessary to clarify the responsibility of the financial department in the field of bidding for essential medicines. The case has two enlightenments for improving the existing legal system of bidding for essential medicines in our country: one is to introduce supporting legal interpretations; the other is that the financial departments at all levels of government make regulatory guidance documents.
