教育部普法办在《关于贯彻全国教育系统“五五”普法规划切实加强教师法制教育工作的通知》中提到:“一些教师法律知识贫乏,法律素质不高,侵害学生合法权益甚至严重侵害学生人身权利的违法犯罪现象还时有发生;有些教师法治观念不强,在维护自身权益时采取不合法的手段和做法,不但影响了正常的教育教学活动和社会秩序,也有损教师的良好形象。”因此,教师是否具有基本的法律知识,是否具备较强的法律意识和自觉应用法律的能力,将直接影响到依法施教、依法治教的治教理念能否实现。
