宪法宣誓制度的建立是一个国家政治文明的体现,世界上绝大多数国家和地区均建立了宪法宣誓制度,我国各地方也早有宪法宣誓现象,但是完善的宪法宣誓制度仍未建立。本文在总结我国各地方宪法宣誓现象、分析借鉴联合国193个成员国宪法规定的基础上,对我国建立宪法宣誓制度提出了系统建议。要建立宪法宣誓制度,关键在于对宪法宣誓主体、程序、时间、地点以及法律地位等内容的规定,难点在于对违反宪法宣誓誓言法律后果的设计。 The constitutional oath system is a manifestation of a country’s political civilization. The constitutional oath system has been established in most countries and regions in the world. The constitutional oath has long existed in various places in our country. However, a sound system of constitutional oath has not yet been established. On the basis of summing up the constitutional oaths in various localities in our country and analyzing the constitutional provisions of the 193 member states of the United Nations, this paper puts forward systematic suggestions on the establishment of a constitutional oath system in our country. The crux of the constitutional oath system is the constitution of the oath of constitution, the procedure, the time, the place and the legal status. The crux lies in the design of the legal consequences of the oath of sworn oath.
