水是生命之源,是生命赖以存活所必须的物质。随着人口的迅速增长,工业的持续发展,人类对水的需要越来越多,对水的污染也越来越严重。然而,我国刑法对人们赖以生存的饮用水污染防治却是空白的,刑法作为具有重大威慑力,具有刚性强制力的保障法应该发挥其应在饮用水污染防治上的独特作用。水污染行为的严重社会危害性决定了将其规定为犯罪的必要性。将水污染行为予以犯罪化是必然趋势。
Water is the source of life and the necessary material for life to survive. With the rapid population growth and continuous industrial development, human beings have more and more need of water and water pollution is getting more and more serious. However, the criminal law in our country lacks control over the pollution of drinking water which people rely on for survival. As a major deterrent, the criminal law has a unique function of prevention and control of drinking water pollution. The serious social hazard of water pollution determines the need to criminalize it. Criminalizing water pollution is an inevitable trend.
