本文目的在于使读者了解国际上租船合同的发展现状,并加深对租船合同中装卸时间用语的理鳃,以利我们在对外开展租船业务时能维护我国的经济权益。全文分三部分。第一部分简要介绍了《80年定义》产生的背景。鉴于多年来有关装卸时间用语解释的分歧有增无减,笔者试图就此探讨租船合同用语统一化的原因及其意义。在第二部分,作者指出《80年定义》脱胎于《77年定义》。通过对二者的比较,笔者认为尽管在某些条目中有船租双方折衷的迹象,但就整体而言,《80年定义》所作的增删和更改几乎都有利于船方。文章的第三部分是作者对《80年定义》的述评,总结了“定义”的特点,探讨了它的作用,并就此向有关方面提出了一些建议。
The purpose of this paper is to help readers understand the status quo of the development of international charter parties and to deepen their understanding of the terms of loading and unloading in charter parties so that we can safeguard China’s economic rights while carrying out charter operations. The full text is divided into three parts. The first part briefly introduces the background of “80-year definition”. In view of the unavoidable differences over the years about the interpretations of terms of loading and unloading time, the author attempts to discuss the reasons and significance of the unification of terms of chartering contracts. In the second part, the author points out that the definition of “80 years” is born from the definition of “77 years.” Through a comparison of the two, I think that although there are signs of compromise between the two parties in some entries, the additions, deletions and changes made by the “80-year definition” are almost always beneficial to the ship as a whole. The third part of the article is the author’s commentary on the definition of “80 years”, summarizes the characteristics of “definition”, discusses its function, and puts forward some suggestions to the parties concerned.
