本文通过描述秋审的仪式性,证明其目的在于建立与上天沟通的桥梁。国家通过秋审大典和勾到仪式,以上天的名义决定犯人生死。秋审制度将地方官吏因死刑裁量权产生的心理负担转移到中央,最终集于皇帝一人,并借助上天的权威得以消解。因此秋审兼具司法和宗教双重性质,其潜在价值在于构建了国家死刑的权威,使国家死刑权力正当化。
By describing the ceremonial nature of autumn trials, this article proves that its purpose is to establish a bridge of communication with God. The state passed the autumn trial ceremony and hook to the ceremony, in the name of heaven to determine the life and death of prisoners. The autumn trial system shifted the psychological burden of local officials on the discretion of death penalty to the Central Government and finally ended up in the emperor alone and was resolved by the authority of God. Therefore, the autumn trial combines both the judicial and the religious duality. Its potential value lies in the construction of the authority of the state death penalty and the justification of the death penalty power of the country.
