本文以非物质文化遗产为对象,首先分析了其内涵,进而研究了通过知识产权保护非物质文化遗产的必要性和可行性。并以著作权保护模式为例,深入探究非物质文化知识产权保护所遇到的理论困境与现实难题。文章认为,非物质文化与现行知识产权制度保护框架既存在契合之处,也有不相适应的地方,而这也许会成为促进传统知识产权制度创新与发展的动力。 This article takes intangible cultural heritage as object, first analyzes its connotation, and then studies the necessity and feasibility of protecting intangible cultural heritage through intellectual property. Taking the model of copyright protection as an example, this paper probes deeply into the theoretical difficulties and realistic problems encountered in the protection of intellectual property of intangible cultural heritage. The article argues that there is not only a combination of non-material culture with the existing framework for the protection of intellectual property systems, but also an incompatible place, which may become the driving force for the innovation and development of the traditional intellectual property system.
