舆论监督权是我国宪法赋予公民的基本权利,司法独立是法治国家的宪法原则和司法原则。两者是现代法治国家中最具有价值的基石,是依法治国的重要组成部分。由于两者各自的特征和运行规律不同,在特殊情形中会发生冲突,造成舆论监督对司法独立的侵犯和司法独立对舆论监督排斥的现象。 The supervisory power of public opinion is the basic right conferred on our citizens by the constitution of our country. The independence of the judiciary is the constitutional principle and the judicial principle of a country ruled by law. Both are the most valuable cornerstone of the modern rule of law and an important part of governing the country according to law. Due to their different characteristics and operating rules, conflict occurs in special situations, causing the supervision by public opinion to be independent of the judiciary and the exclusion of public opinion from judicial independence.
