已有效提起之诉是否具备诉讼要件,是实体辩论和实体裁判的前提.本文从诉讼要件的概念出发,讨论了诉讼要件的构成体系以及诉讼要件对民事审判的指导作用.为深入理解诉讼要件的特点、功能,对诉讼要件与我国民事诉讼法理论中相关概念的关系也进行了论述.
