刑事法律援助制度的健全与否是衡量一国刑事诉讼现代化程度的一个重要参考指标,其制度设计往往都蕴含着一国对人权保障的尊重程度。在犯罪嫌疑人处于被追诉而无力聘请辩护律师的情况下,刑事法律援助就成为被告保障自身诉讼权益的唯一可能路径。我国刑事法律援助制度的完善,首先需对修法初衷的效果进行分析,然后对制度运行的现状进行考察并找准问题症结,最后需从体制机制上进行通盘考虑。为此,应当完善刑事法律援助案件的管理投入机制,明确刑事法律援助案件的办案补贴机制,建立刑事法律援助案件的质量监测机制,畅通刑事法律援助案件的多方联动机制,健全刑事法律援助案件的惩罚奖励机制。
