中国加入WTO已经指日可待,人们关注最多的是加入WTO对于某一行业或某一领域在经济方面的影响如何。笔者认为,中国加入WTO,最大的挑战是对各级政府行政管理的挑战,迫切需要研究的是政府的行政管理应如何适应WTO。特别是地方政府,更应主动研究,积极应对,尽早适应。众所周知,WTO是在GATT(关税与贸易总协定)乌拉圭回合多边谈判的基础上于1995年1月1日正式成立的。WTO兼具国际组织、国际条约、国际谈判场所和协议执行机构四大功能。WTO众多的协议、附件、决定和谅解等法律性文本的法律体系框架体现了以下主要原则:非歧视贸易原则;自由贸易原则;权利与义务平等原则;透明和可预见原则;公平竞争原则;激励发展和经济改革原则。
Since China’s accession to the WTO is just around the corner, most people are concerned about the economic impact of joining the WTO on a certain industry or a certain field. The author believes that China’s accession to the WTO, the biggest challenge is the challenge of the administration at all levels of government, the urgent need to study is how the government’s administration should adapt to WTO. In particular, local governments should take the initiative to study and actively respond to them as soon as possible. As we all know, the WTO was formally established on January 1, 1995 on the basis of the GATT (General Agreement on Tariffs and Trade) multilateral negotiations in Uruguay Round. WTO combines the four major functions of international organizations, international treaties, international negotiation venues and agreement enforcement agencies. The legal system framework of many WTO legal texts such as agreements, appendices, decisions and understandings embodies the following key principles: the principle of non-discrimination trade; the principle of free trade; the principle of equal rights and obligations; the principle of transparency and foreseeability; the principle of fair competition; the principle of fair competition Development and economic reform principles.
